Tourists are not immune from injury

In 2016, almost 8.9 million tourists came to Hawaii. Sunshine, fun and an unforgettable vacation greeted most of these tourists. However, it would be impossible that all these millions of tourists would be protected against harm or even death.

Their participation in high-risk activities increase the potential for harm. Snorkeling, fishing and scuba diving in unfamiliar oceans, parasailing and skydiving are among these activities. Tourists drown at a much greater rate than residents. However, visitors are not exempt from personal injuries that can harm Hawaiians, such as a drunk driver, a negligent doctor, a speeding motorist, a dog bite or slipping and falling in a restaurant.

Residents go to great lengths to protect their guests. However, tourists still suffer injuries when a responsible party does not exercise their duty of care by failing to identify dangers at beaches, provide adequate equipment, correct a dangerous condition or take other reasonable precautions. A person impaired by drugs or alcohol is also a risk to tourists in any circumstances. Criminal activity can also pose an unreasonable risk of harm
