Many people in Hawaii need help at some point in time. Most people are not experts in everything that may go wrong with their house, car, finances and other aspects of life. Therefore, when they need plumbing help, assistance fixing electrical issues, fixing their cars or help with other problems they call plumbers, electricians and go to car mechanics to have the problems fixed. So, naturally when something goes wrong with their health they go to doctors and other medical professionals.
Just like when people hire others to work for them, they expect that doctors will do their job correctly. They expect that the doctor will do everything they can to heal them. However, doctors are like anybody else and from time to time they make mistakes. Unfortunately their mistakes can cause major health problems for the victim and in fact put them in a worse position than when they first went to the doctor.
If this does happen, the victim may have a medical malpractice claim against the doctor or medical professional. If they are successful, the doctor may have to compensate the victim for the damages they caused as a result of their negligence. However, the claim must be filed within certain time limits, otherwise the person may lose their opportunity to file the lawsuit. People must file the claim within two years of learning of the injury and in any case not more than six years after the doctor made the mistake and caused the injury.
Most of the time when people go to the doctor, their condition does in fact improve. Also, certain things that happen are out of the control of a doctor and there is nothing they can do. Unfortunately though sometimes doctors also make mistakes and make the problem worse for the victim. People who suffer further injuries due to these mistakes may have a claim for medical malpractice against the doctor. These are very complicated cases and experienced attorneys may be able to guide one through the process.
