The 70-year-old man was reportedly riding his bicycle on the shoulder of a highway, when he was struck by a vehicle that allegedly ran off the road. The bicyclist was pronounced dead at the scene of the accident.

According to the woman’s lawsuit, the driver of the vehicle was negligent in that he failed to yield the right-of-way. Police reportedly said that speed may have been a factor in the accident, but were unsure if the driver was intoxicated at the time. The driver was arrested on charges of negligent homicide, but charges have not been filed as of today.
